1. บริการนี้คืออะไร

PaiNam (ไปนำ) เป็นแพลตฟอร์มตัวกลางที่ช่วยให้ผู้ที่เดินทางเส้นทางเดียวกันได้พบกันและ ร่วมเดินทางโดยหารค่าใช้จ่าย (เช่น ค่าน้ำมัน ค่าทางด่วน) เท่านั้น แพลตฟอร์มไม่ใช่ผู้ให้บริการขนส่ง ไม่ใช่บริการรถรับจ้าง และไม่เก็บค่าธรรมเนียมหรือค่าคอมมิชชันจากการเดินทาง

2. ค่าร่วมเดินทาง

ราคาทุกรายการเป็น บาทต่อที่นั่ง สำหรับระยะทางของผู้โดยสาร
ราคาแนะนำ - บาท/กม. และระบบไม่อนุญาตให้ตั้งราคาหรือต่อรองเกิน - บาท/กม.
ค่าร่วมเดินทางมีไว้เพื่อแบ่งเบาค่าใช้จ่ายจริงของการเดินทาง ห้ามใช้เพื่อหารายได้หรือกำไร และห้ามเรียกเก็บเงินเพิ่มนอกเหนือจากที่ตกลงในระบบ
การชำระเงินเป็นเรื่องระหว่างผู้ใช้โดยตรง แพลตฟอร์มไม่รับ ไม่ถือ และไม่โอนเงินแทนผู้ใช้

3. คุณสมบัติของผู้ใช้

ผู้ใช้ต้องมีอายุ 15 ปีขึ้นไป ผู้ที่อายุต่ำกว่า 20 ปีต้องได้รับความยินยอมจากผู้ปกครองก่อนใช้งาน
ผู้ขับต้องมีใบอนุญาตขับขี่ที่ยังไม่หมดอายุตรงกับประเภทยานพาหนะ ยานพาหนะต้องจดทะเบียนถูกต้อง เสียภาษีประจำปี และมีประกันภัยตาม พ.ร.บ.คุ้มครองผู้ประสบภัยจากรถที่ยังมีผล

4. หน้าที่ของผู้ใช้

ให้ข้อมูลที่เป็นจริงและเป็นปัจจุบัน
ปฏิบัติตามกฎจราจรและกฎหมายที่เกี่ยวข้องตลอดการเดินทาง
ผู้ขับควรตรวจสอบเงื่อนไขกรมธรรม์ประกันภัยภาคสมัครใจของตนเอง ว่าคุ้มครองการรับผู้โดยสารร่วมเดินทางหรือไม่
เคารพความเป็นส่วนตัวของผู้ใช้อื่น ไม่นำข้อมูลที่เห็นในระบบไปใช้นอกเหนือจากการนัดหมายเดินทาง

5. ข้อห้าม

ใช้บริการเพื่อประกอบกิจการรับส่งผู้โดยสารเชิงพาณิชย์ หรือรับจ้างขนส่ง
คุกคาม ข่มขู่ เลือกปฏิบัติ หรือละเมิดผู้ใช้อื่น ทั้งในแชทและระหว่างการเดินทาง
แอบอ้างเป็นผู้อื่น สร้างบัญชีปลอม หรือให้ข้อมูลเท็จ
ขนส่งสิ่งของผิดกฎหมาย หรือใช้บริการเพื่อกระทำความผิดใด ๆ
พยายามเข้าถึงระบบหรือข้อมูลโดยไม่ได้รับอนุญาต หรือรบกวนการทำงานของระบบ

6. ความรับผิด

แพลตฟอร์มทำหน้าที่จับคู่และให้ช่องทางติดต่อเท่านั้น ข้อตกลงการเดินทางเกิดขึ้นระหว่างผู้ใช้โดยตรง แพลตฟอร์มไม่รับประกันความถูกต้องของข้อมูลที่ผู้ใช้กรอก และไม่รับผิดต่อความเสียหายที่เกิดจากการเดินทาง ระหว่างผู้ใช้ เว้นแต่ความเสียหายนั้นเกิดจากความจงใจหรือประมาทเลินเล่ออย่างร้ายแรงของแพลตฟอร์ม หรือกฎหมายห้ามมิให้จำกัดความรับผิด

7. การระงับบัญชี

แพลตฟอร์มอาจระงับหรือลบบัญชีที่ฝ่าฝืนข้อตกลงนี้ ผู้ใช้ลบบัญชีของตนเองได้ทุกเมื่อที่หน้าโปรไฟล์

8. ข้อมูลส่วนบุคคล

การเก็บและใช้ข้อมูลส่วนบุคคลเป็นไปตามประกาศความเป็นส่วนตัว

9. การแก้ไขข้อตกลง

เมื่อมีการแก้ไขข้อตกลงหรือประกาศความเป็นส่วนตัว ระบบจะขอให้ผู้ใช้อ่านและกดยอมรับเวอร์ชันใหม่ก่อนใช้งานต่อ

10. กฎหมายที่ใช้บังคับ

ข้อตกลงนี้อยู่ภายใต้กฎหมายแห่งราชอาณาจักรไทย

1. What this service is

PaiNam (ไปนำ, "let's go together") is an intermediary platform that helps people travelling the same route find each other and travel together while sharing costs only (such as fuel and expressway tolls). The platform is not a transport provider and not a ride-hailing or taxi service, and it charges no fees or commissions on trips.

2. Cost sharing

All prices are baht per seat for the passenger's distance.
The suggested price is - baht/km, and the system does not allow setting or negotiating more than - baht/km.
The cost share exists to split the actual costs of the trip. It must not be used to earn income or profit, and no money may be charged beyond what was agreed in the system.
Payment is directly between users. The platform does not receive, hold or transfer money on behalf of users.

3. Who can use the service

Users must be at least 15 years old. Users under 20 must have a parent's or guardian's consent before using the service.
Drivers must hold a valid driving licence for the type of vehicle. The vehicle must be properly registered, have its annual tax paid, and carry valid compulsory motor insurance (under the Protection for Motor Vehicle Accident Victims Act).

4. User responsibilities

Provide true and up-to-date information.
Follow traffic rules and all applicable laws throughout the trip.
Drivers should check whether their voluntary insurance policy covers carrying passengers who share a ride.
Respect other users' privacy and do not use information seen in the system for anything other than arranging the trip.

5. Prohibited conduct

Using the service to run a commercial passenger transport business or to carry people or goods for hire.
Harassing, threatening, discriminating against or abusing other users, in chat or during a trip.
Impersonating others, creating fake accounts or giving false information.
Transporting illegal items or using the service to commit any offence.
Attempting to access the system or data without permission, or disrupting the system.

6. Liability

The platform only matches users and provides a way to contact each other. Trip arrangements are made directly between users. The platform does not guarantee the accuracy of information entered by users and is not liable for damage arising from trips between users, except where the damage results from the platform's wilful misconduct or gross negligence, or where the law does not allow liability to be limited.

7. Account suspension

The platform may suspend or delete accounts that breach these terms. You can delete your own account at any time on the profile page.

8. Personal data

Personal data is collected and used as described in the Privacy Notice.

9. Changes to these terms

When these terms or the Privacy Notice change, the system will ask you to read and accept the new version before continuing.

10. Governing law

These terms are governed by the laws of the Kingdom of Thailand.
